Zoning Code Amendments February 4th 2021

The Town Board will call for public hearing on several proposed code amendments at its January 19th 2021 meeting. The public hearings would take place at the February 4th 2021 meeting. The resolutions are to amend the following sections of code:

Solar Overlay District - both the solar definitions and solar overlay district were drafted to enable parcels 30 acres or more that have a boundary line within 1/2 mile of a substation to construct a solar farm for the purpose of selling energy to the local utility company. The Glenville Environmental Conservation Commission conducted a Type I SEQR Action and reviewed the text. The proposed code amendment was also reviewed by the County under General Municipal Law (GML) 239-m. The section regarding Site Plan was amended to add a public benefit fee requirement for solar farms approved under the solar farm overlay district.

Adult Use Overlay District - both the full definitions and overlay district include clarifications of the intention of exempting Vapor Shops from retail and adding these facilities to the adult use overlay district. The definition clarifies the inclusion of CBD oil and recreational marijuana as exempted from permitted retail. Both were added to the Adult Use Overlay District.

Fees - Chapter 139 lists building and planning department fees. Several were increased in response to the amount of time required for demolition and pool installations. A zoning certificate letter was added with a fee of $25.
