TOWN OF GLENVILLE
ZONING BOARD OF APPEALS


        PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, May 19, 2014 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.


        Application of Clay & Sandra Ernst, 25 Oakhurst Drive, Scotia, NY  12302 for a Conditional Use Permit that will allow for the construction of a new single-family dwelling with an accessory apartment at property located at 36 Van Voast Lane, Glenville, NY  12302.  Said property is located in a Suburban Residential Zoning District and is identified on tax map: 21.2-1-12.16.
        In accordance with the Codes of the Town of Glenville 270-15, D: Accessory apartments are permitted in the SR zoning district by Conditional Use Permit and must also comply with 270-51 of the Town Codes.


        Application of Anthony Moro, 101 Skyway Drive, Glenville, NY  12302 for a Side Yard Setback Area Variance that will allow for the construction of a new 28' x 42' two story garage/living space addition to be located 10' 11" from the side lot line.  Said property is located in a Suburban Residential Zoning District and is identified on tax map 22.18-2-23.
        In accordance with the Codes of the Town of Glenville 270-Attachment 1 the minimum side setback in the SR zoning district is 15'.  The applicant is requesting a 6' side yard setback.


        Application of Richard Rollins, 775 Maura Lane, Glenville, NY  12302 for an Area Variance that will allow for the installation of an Inground Swimming Pool to be located 9' from the existing dwelling.  Said property is located in the Suburban Residential Zoning District and is identified on tax map 21.2-2-28.
        In accordance with the Codes of the Town of Glenville a swimming pool is considered an accessory structure and 270-3 requires a minimum distance of 10' from the dwelling to any accessory structure.  Therefore, the applicant is seeking a variance of 1'.


        Application of Benderson Development Company, LLC, 570 Delaware Avenue, Buffalo, NY  14202 on behalf of Mayfair Associates for a Conditional Use Permit that will allow for the redevelopment of the former Teresa's Restaurant at 268 Saratoga Road, Glenville, NY  12302.  The proposal calls for the demolition of the existing 3,349 s/f structure and the construction of a new 6,400 s/f restaurant, associated parking and utilities. As part of the project this 21,277 s/f parcel will be combined with the larger Mayfair Shopping Center parcel.  Said property is located in the General Business Zoning District and the Town Center Overlay District and is identified on tax map 22.7-6-2.
        In accordance with the Codes of the Town of Glenville 270-19, Restaurants are permitted by Conditional Use Permit.


        Application of Benderson Development Company, LLC, 570 Delaware Avenue, Buffalo, NY  14202 on behalf of Mayfair Associates for Two Area Variances associated with the creation of 57 new parking spaces located at the Northeast corner of property at 262 Saratoga Road, Mayfair Shopping Center.   Said property is located in the General Business Zoning District and the Town Center Overlay District and is identified on tax map 22.-1-1.2.
        In accordance with the Codes of the Town of Glenville the following variances are being sought:
1)      270-73, C, 3: new parking spaces must be a minimum of 10' from the side lot line.  The applicant is proposing new spaces 2'9" from the lot line and is therefore requesting a 7'3" variance.
2)      270-141, C, 2: all new parking areas consisting of 20 or more spaces must be provided with 1 internal landscape island for each 10 spaces.  This proposal requires 6 landscape islands, the applicant has proposed none and is therefore requesting a variance of 6 landscape islands.
