TOWN OF GLENVILLE
ZONING BOARD OF APPEALS


        PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, April 23, 2012 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.


        Application of George and Denise Toften, 2964 Amsterdam Road, Glenville, NY  12302 for an Area Variance to allow for the placement of a 22’ x 22’ two stall metal detached garage in a front yard for his personal residential use.  Said property is located in a General Business Zoning District and is a legally non-conforming residential/ single family use.  This property is also a “through-lot” and therefore has two front yards.  Tax map: 20.20-1-3.
        In accordance with the Codes of the Town of Glenville 270-9, C: No permitted accessory use or building shall be located in any front yard.  Therefore the applicant is seeking total relief from this section of the code.


        Application of Kathleen McClary, 1741 Amsterdam Road, Glenville, NY  12302  for an Area Variance  to allow for the installation of a 20’ x 32’ inground swimming pool in the front yard. Said property is located in the Suburban Residential Zoning District.  Tax map: 29.-4-15.
        In accordance with the Codes of the Town of Glenville 270-54(A)(2): swimming pools are not permitted in front yards.  Therefore the applicant is seeking total relief from this section of the code.


        Application of Kathleen McClary, 1741 Amsterdam Road, Glenville, NY 12302  for an Area Variance that will allow for the placement of a 6’ high white vinyl stockade fence
(63 l/f) in the front yard.  Said property is located in the Suburban Residential Zoning District.  Tax Map:  29.-4-15
        In accordance with the Codes of the Town of Glenville 270-52 (B)(2): Fences on residential properties will not exceed four feet in height in the front yard.  Therefore the applicant is seeking total relief from this section of the code.


Application of Travis Hudson, 153 South Kingsboro Ave., Gloversville, NY  12078, acting on behalf of the current property owner Bernice V. Kerwin, 29 Carole Jean Lane, Clifton Park, NY  12065 for Two Area Variances that would allow for the construction of a new single family dwelling on Sacandaga Road. to be located 20 feet from the northern side lot line and 44 feet from the southern side lot line.   Said property is located in the Rural Residential Zoning District.  Tax Map:  14.3-4-1.
        In accordance with the Codes of the Town of Glenville 270-Attachment 1 – the minimum side yard setbacks for a single family dwelling in the RRA Zoning District shall be 50’ each.  Therefore the applicant is seeking two variances as follows:
1)      A side yard variance of 30 feet to the northern side lot line.
2)      A side yard variance of 6 feet to the southern side lot line.



Application of Hanley Sign Co on behalf of Fortitech, Richard Schleif, 2105 Technology Drive, Schenectady, NY 12308, for a Sign Variance  that will allow for the installation of a new 120.28 s/f wall sign at 300 Tech Park Road, Glenville, NY 12302.  This sign will replace the existing 50 s/f wall sign.  Said property is located in the Research Development and Technology District.  Tax map:  22.-1-10.72
In accordance with the Codes of the Town of Glenville 270-134 (C)(6)(5): Facade signs shall not exceed 50 s/f in size.  Therefore the applicant is seeking a variance of 70.28 s/f variance.

Application of Consulting and Design, LLC on behalf of Quadmo Ltd, Steve Weeks, 541 Clifton Park Center Road, Clifton Park, NY  12065 for an Area Variance that will allow for the existing drive-thru to be increased to 13’ wide which will bring it to a distance of 7’ 1” from the side lot line.  The existing drive-thru is 10’ 10” wide and located 9’ 2” from the side lot line.  Said property is located within the Town Center Overlay and is zoned General Business.  Tax map: 22.11-3-12.1
In accordance with the Codes of the Town of Glenville 270-73 (C)(4): … A parking lot (including its entrance and exit driveways) serving a nonresidential or multifamily use may not be located any closer than 40 feet to the property line of a single  or two family dwelling…  Although it is a 2’ 2” increase from current site conditions, since no prior variance was found in Town records for this drive-thru, the applicant is now seeking a variance of 33’


        Application of Consulting and Design, LLC on behalf of Quadmo Ltd, Steve Weeks, 541 Clifton Park Center Road, Clifton Park, NY  12065  for a Sign Variance (variance #1) that will allow for the internal illumination of an existing 2’ x 7’ (14 s/f) “Xtramart” wall sign at the Sunoco Station, 245 Saratoga Road, Glenville NY 12302.  Said property is located within the Town Center Overlay District and is zoned General Business.  Tax map: 22.11-3-12.1
        In accordance with the Codes of the Town of Glenville 270-133 (I)(4)(b) Design Standards within the Town Center Overlay District:  Prohibited signs include internally lit signs.
Therefore the applicant is seeking total relief from this section of the code.


        Application of Consulting and Design, LLC on behalf of Quadmo Ltd, Steve Weeks, 541 Clifton Park Center Road, Clifton Park, NY  12065  for a Sign Variance (variance #2) that will allow for the internal illumination of an existing 2’ 11” x 5’ 7” (16.28 s/f) “Dunkin Donuts” wall sign at the Sunoco Station, 245 Saratoga Road, Glenville NY 12302 .  Said property is located within the Town Center Overlay District and is zoned General Business.  Tax map: 22.11-3-12.1
        In accordance with the Codes of the Town of Glenville 270-133 (I)(4)(b) Design Standards within the Town Center Overlay District:  Prohibited signs include internally lit signs.
Therefore the applicant is seeking total relief from this section of the code.


        Application of Consulting and Design, LLC on behalf of Quadmo Ltd, Steve Weeks, 541 Clifton Park Center Road, Clifton Park, NY  12065  for a Sign Variance (variance #3) that will allow for the internal illumination of an existing nonconforming 22’ x 4’7” pole sign at the Sunoco Station, 245 Saratoga Road, Glenville NY 12302 .  The pole sign consists of 5 individual signs totaling 63 s/f in actual sign area.  Said property is located within the Town Center Overlay District and is zoned General Business.  Tax map: 22.11-3-12.1
        In accordance with the Codes of the Town of Glenville 270-133 (I)(4)(b) Design Standards within the Town Center Overlay District:  Prohibited signs include internally lit signs.
Therefore the applicant is seeking total relief from this section of the code.


        Application of Consulting and Design, LLC on behalf of Quadmo Ltd, Steve Weeks, 541 Clifton Park Center Road, Clifton Park, NY  12065  for a Sign Variance (variance #4) that will allow for the internal illumination of one existing 1’ 10” x 8’ (14.66 s/f) “Sunoco” sign located on the canopy over the fuel pumps at the Sunoco Station, 245 Saratoga Road, Glenville NY 12302 .  The pole sign consists of 5 individual signs totaling 63 s/f in actual sign area.  Said property is located within the Town Center Overlay District and is zoned General Business.  Tax map: 22.11-3-12.1
        In accordance with the Codes of the Town of Glenville 270-133 (I)(4)(b) Design Standards within the Town Center Overlay District:  Prohibited signs include internally lit signs.
Therefore the applicant is seeking total relief from this section of the code.
