TOWN OF GLENVILLE
ZONING BOARD OF APPEALS


        PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, July 26, 2010 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.


        Application of Rocco Montesano, 17 Glen Terrace, Glenville, NY  12302 for an Area Variance that will allow for the construction of a deck to extend into the front yard of Daphne Drive.  The proposed deck will be located behind an existing stockade fence and will be setback approximately 35 feet from the front lot line.  Said property is located in a Suburban Residential Zoning District and is identified on tax map 22.7-3-5.
        In accordance with the Codes of the Town of Glenville 270-9, C - Location.  No permitted accessory structure or building shall be located in any front yard.  Therefore, the applicant is seeking full relief from this section of the ordinance.


        Application of William & Linda-Mae Newman, 612 Elliott Street, Glenville, NY  12302 for Three Area Variances that will allow for the construction of a new 26' x 24' (624 s/f) detached garage with side and rear yard setbacks of 5 feet.  The existing detached garage will be demolished as part of this project.  Said property is located in a Suburban Residential Zoning District and is identified on tax map 38.11-2-29.
        In accordance with the Codes of the Town of Glenville the applicant is seeking the following three variances:
        Variance #1:  270-9, G, (2) - All accessory structures up to 576 s/f in size must be located a minimum of 10 feet from the rear property line, Therefore, the applicant is seeking a rear yard variance of 5 feet.
        Variance #2:  270-9, G, (2) - All accessory structures up to 576 s/f in size must be located a minimum of 10 feet from the side property line,  Therefore, the applicant is seeking a side yard variance of 5 feet.
        Variance #3:  270-9, G, (2) - Accessory structures in the Suburban Residential zoning district are permitted up to 576 s/f in size.  Therefore, the applicant is seeking a square footage variance of 48 s/f.


        Application of the Golub Corporation, 461 Knott Street, Schenectady, NY  12308 for Three Sign Variances that will allow for a total of 15 new signs on the Price Chopper facade at 300 Saratoga Road, Glenville, NY  12302.  Three will be internally illuminated and have plastic in the face. The new signs will be in addition to the existing Price Chopper facade and pole signs which will be re-faced.  Said property is located in the General Business and the Town Center Overlay Districts and is identified on tax map 22.7-6-6
        In accordance with the Codes of the Town of Glenville the applicant is seeking the following three variances:
        Variance #1:  270-133, I, 4, b - Prohibited signs - Internally lit signs are prohibited.  Therefore the applicant is seeking full relief from this section of the ordinance for three new signs.
        Variance #2:  270-133, I, 5, a - Materials - Facade  signs shall be made of wood, simulated wood, or composite materials, or carved and/or sandblasted and finished with gold leaf or paint stains.  Therefore, the applicant is seeking full relief from this section of the ordinance for three signs.
        Variance #3: 270-133, I, 5, i - Number of signs -  A maximum of one facade sign per use is permitted.  Therefore the applicant is seeking a variance to allow for 15 additional facade signs.


        Application of Richard J. DiCresce Jr., 112 Sanders Ave, Scotia, NY  12302 for a Conditional Use Permit that will allow for the construction of a new 60' x 40' (2,400 s/f) building to be used for an auto inspection facility located at 178 Freemans Bridge Road, Glenville, NY  12302.  The existing auto sales facility will remain.   The property is located in the General Business Zoning District and is identified on tax map 30.10-3-3.
        In accordance with the Codes of the Town of Glenville 270-19, D, 3 - Automobile repair shops are permitted by Conditional Use Permit and Site Plan Review.  Therefore, the applicant requires approval of a Conditional Use Permit to construct and establish an auto inspection facility.
