ZONING BOARD OF APPEALS

        PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road,Glenville, NY 12302-4518 on February 25, 2008 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.

Application of Richard Matott, 1702 Vley Road, Glenville, NY  12302 for an Area Variance to allow for the construction of a 28’ x 48’ detached garage.  There is current already one detached garage; therefore, the proposed structure would be the second garage on the property.  Said property is located on tax map 29.-2-4.1 and is located in the Suburban Residential Zoning District.
        In accordance with the Codes of the Town of placeCityGlenville §270-9(A)(1) Only one garage (attached or detached) is permitted per residential lot and it shall be limited to three stalls.

Application of David Ogawa, 658 Washout Road, Glenville, NY  12302 for two Area Variances to allow for the construction of a 30’ x 45’, 257 square feet, detached garage in the front yard.  The accessory structure would exceed 75% of the footprint of the principle dwelling.  Said property is located on tax map 13.-2-2.11 and is located in the Rural Agricultural/ Residential Zoning District.
        In accordance with the Codes of the Town of placeCityGlenville §270-9(C) states that no accessory structures will be located in any front yard and §270-9(H) states that the combined footprint of al accessory structures on a residentially developed lot shall not exceed 75% of the footprint of the dwelling.

Application of James Halse, 143 Wood Dale Drive, Ballston Lake, NY  12019 for three Area Variances to allow for the construction of a new single family dwelling to be located at 22 Elliott Street, Glenville, NY 12302, with a 5’ side yard set back to the easterly side and an 11’ side yard setback on the westerly side. The applicant is also requesting to construct a detached garage with a 5’ side yard setback on the westerly side.   Said property is located on tax map 38.11-4-22 and is located in the Suburban Residential Zoning District.
        In accordance with the Codes of the Town of placeCityGlenville §270-9(E) states that no accessory structures will be located closer than 10’ to a side or rear lot line and §270-attachment 1 states that the minimum side yard setback is 15’.

Application of David and Nancy Viall, 532 Barhydt Road, Glenville, NY  12302 for an Area Variance that will allow for the construction of a new 30’ x 50’ detached garage with an average height of 20’ 6”.  This structure would be in addition to the existing attached garage on the property.  Said property is located in a Rural Residential Zoning District and is identified on tax map 20.-4-54.
        In accordance with the Town of placeCityGlenville Zoning Ordinance
§ 270-9 Item A - … one garage (attached or detached) is permitted per residential lot, and it shall be limited to a maximum of three stalls and § 270-9(D) sates that no accessory structure shall exceed 15 feet in height.
