ZONING BOARD OF APPEALS

        Please take notice that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, September, 28, 2015 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.

JOSHUA & TAMMY IACOBUCCI, for a rehearing of a Conditional Use Permit in regards to a new duplex dwelling at 201 Maple Ave. Ext (Lot 3).    The applicants are requesting a reconsideration of a condition placed on the previous approval.  The property is identified on tax map: 23.9-4-18.

SUZANNE & ERIC HARRIS, 8 LORELEI LANE, GLENVILLE, NY 12302 for an Area Variance to allow for a pool deck to be located in the front yard.  The deck has been constructed and has been placed 10' from the front lot line of Robinson Road.  Property is a corner lot with two front yards located in a Suburban Residential Zoning District and identified on tax map: 22.14-1-35.
        270-9,C: No permitted accessory structure shall be located in any front yard.

DAVID RINGWALL, 919 GREEN CORNERS ROAD, AMSTERDAM, NY 12010 for an Area Variance to allow for the installation of a 14' x 65' (910 s/f) freestanding solar array system to be located in the front yard.  Property is located in the Rural Residential/Agricultural Zoning District and identified on tax map: 3.-1-41.11.
        270-9,C:  No permitted accessory structure shall be located in any front yard.

RONALD FETCHO, 26 SPRING ROAD, GLENVILLE, NY 12302 for an Area Variance to allow for a 24' x 5' freestanding solar array system to be located in the front yard.  The applicant proposes to place the array 5' from the front property line.  Property is located on the corner of Spring Road and Haviland Drive, located in the Suburban Residential Zoning District and identified on tax map 29.7-1-1.
        270-9,C:  No permitted accessory structure shall be located in any front yard.
                
AJ SIGNS ON BEHALF OF NAVAJO LTD for two sign variances at 270/272 Saratoga road, Glenville, NY 12302.  The applicant would like to install a new 24 s/f, 8' high monument to advertise 4 businesses.  The second sign is proposed to be located 2.5 feet from the front property line. Property is located in the General Business and Town Center Overlay Districts and identified on tax map: 22.7-6-3.1
270-133,I,5,i:  A maximum of one monument sign is permitted. The existing pole sign for Midas would remain, making the proposed monument sign the second sign.
270-133,I,5,h:  Monument signs shall have a minimum setback of 10' from the ROW line and will not interfere with required minimum sight distance at driveways.  The new monument sign is proposed to have a setback of 2.5 feet from the front property line.

AJ SIGNS ON BEHALF OF GLENN DEVELOPMENT LLC  for Three Sign Variances at 5-13 Saratoga Road, Glenville, NY 12302.  The applicant is proposing to install a new 47 s/f , 10'11" high monument sign with space to advertise 3 businesses.   The property is zoned General Business and identified on tax map 30.6-1-15.11
        270-134, C, 6, b, 11:  Number of Signs…a maximum of one monument or pylon sign is permitted per driveway up to a maximum of three monument signs, pylon signs, or combination, except if two or more signs are to be permitted, driveways must be separated by a minimum of 200 feet as measured from center line to center line.  The property has two driveways permitting the two existing signs, the applicant wishes to erect a third sign and is seeking a variance for the additional sign.
        270-134, C, 6, b, 5:   Size:  Monument signs shall have a maximum area of 65 s/f per sign face for the primary sign and 24 s/f per sign face for any secondary signs.   The applicant proposes an additional sign which is 47 s/f in size, 23 s/f larger than permitted.
        270-134,C, 6, b, 4:  Height:  Monument signs shall be no greater than eight (8) feet in height above grade.  The proposed sign is 10' 11", 2' 11" higher than permitted.

AJ SIGNS ON BEHALF OF REGINA GRECO for Two Sign Variances at Capitaland Subaru, 39 Saratoga Road, Glenville, NY  12302.  The applicant is proposing to install a new 21' tall 70.19 s/f  pole sign.   As part of this project, the existing 36 s/f GMC Capitaland pole sign would remain while the existing 75 s/f Subaru pole sign would be removed.  The property is zoned General Business and identified on tax map 30.6-1-9.
        270-134, C, 6, b, 11:  Number of Signs…a maximum of one monument or pylon sign is permitted per driveway up to a maximum of three monument signs, pylon signs, or combination, except if two or more signs are to be permitted, driveways must be separated by a minimum of 200 feet as measured from center line to center line.  The property has one driveway allowing for one pole sign.  The applicate is seeking approval for one additional pole sign, for a total of 2 pole signs on the property.
        270-69, C, 6:  Individual pole signs cannot exceed 65 s/f.  The proposed pole sign is 70.19 s/f in size.
