“SPECIAL ORGANIZATIONAL” MEETING OF THE TOWN BOARD
TOWN OF GLENVILLE
JANUARY 5, 2011
AT THE GLENVILLE MUNICIPAL CENTER

    Supervisor Koetzle called the meeting to order at 7:30 PM;  
 
    Supervisor Koetzle asked the Town Clerk, Linda C. Neals, to call the roll.   
 
Present:  Supervisor Christopher A. Koetzle, Councilmen Alan Boulant, Mark Quinn,
Sid Ramotar and Councilwoman Gina M. Wierzbowski
 
Absent:  None
 
    Supervisor  Koetzle  administered  the  “Oath  of  Office”  to  Councilwoman
Wierzbowski and Judge Davenport administered the “Oath of Office” to Town Justice Brian
Mercy.
 
    Supervisor Koetzle  –  “I would  like  to  take  a moment  to  clarify where  this
Board is going over the next couple of months.
 
    Last month we were all saddened to  learn that our most senior member of
the Town Board, Councilman Quinn, will be  leaving us sometime  this year  to accept  the
position  of  Deputy  Commissioner  within  the  Schenectady  County  Board  of  Elections.  
Since Councilman Quinn made that announcement the Board has received expressions of
interest  for  the  soon  to be  vacant  seat  from several qualified  candidates.   To be  fair  to
those  applicants  the  remaining members  of  the  Town  Board,  whose  duty  it  will  be  to
appoint a successor and all be enrolled in the same political party, interviewed candidates
in a political caucus.  I believe that the Board members have reached a consensus on an
extremely qualified candidate.    In order  to do our due diligence we are prepared now  to
publicly discuss our tentative choice in a work session to be held on January 12th here at
Town Hall.  If after that session the members of the Board publicly agree on the candidate
the Board will be prepared  to act as  soon as  the  vacant  seat  is  created.    I believe  the
entire Board believes  it  is  in  the best  interest of  the Town  that we make a selection as
early  as  possible  so  the  new  Board member  can  get  up  to  speed  quickly  on  pressing
issues facing the Town and so that the Board and the residents of the Town can have the
benefit of this persons input as we develop our strategic plan and goals for the fiscal year,
2011.
 
    I have also determined that it is in this Towns best interest to make certain
changes  to  the assigned  liaison  roles, which we will  talk about  later and give people an
opportunity  to  work  in  different  areas  there  by  gaining  a  fuller  understanding  and
appreciation for town departments and the work that they do and to match the skill sets of
the Board members to the assignments as best as possible.
 
    For developing our goals and objectives and continuity through out the year
it is best that we make these liaison assignments at the beginning of the year to those who
will be responsible for carrying out the assignments throughout the year.  So we are going
to  be  a  little  premature  and make  some  committee  assignments  although we may  not
have  everybody  in  place.    Fortunately  for  us  our  tentative  choice  to  fill  the  soon  to  be
vacated board seat  is very  familiar with  local government, particularly Town and Village
relations and  is  intimately  familiar with public safety and dispatch  issues.   Having served
with distinction for many years as the Chief of Police in the Village of Scotia it is my distinct
pleasure to announce that at our Town Board work session we will formally interview John
Pytlovany  as  a  candidate  for  the  appointment  to  the  Glenville  Town  Board.   We  are
confident that given his experience and continued involvement in our community John will
be able to hit the ground running and will be able to immediately step up into the position
on the Board.
 
    I  invite any  interested Town resident  to attend our work session next week
and to submit to me or any member of this Board any questions that you may want John to

process as we complete it next week and say that we are looking forward to it.”

categories and if the Board consents we can take them up on consent.  If a Board member

    Councilman Boulant made a motion to consider #1–6 on consent, Seconded

RESOLUTION NO. 1-2011

    BE  IT  RESOLVED,  that  the  regular meetings  of  the  Town  Board  of  the
Town of Glenville shall be held on the first and third Wednesday of the month during the
year 2011, excepting the months of June, July and August when the said regular meetings
shall be held only on the third Wednesday of those respective months, and
 
    BE  IT  FURTHER  RESOLVED,  that  the  Town  Board  will meet  in  a  work
session on the second Wednesday of each month on an as needed basis; and
 
    BE IT FURTHER RESOLVED, that all regular meetings and work sessions
shall convene at 7:30 P.M., prevailing time, unless otherwise designated, within sufficient
time  and  shall  be held  at  the Glenville Municipal Center,  18 Glenridge Road, Glenville,
New York, and
 
    BE  IT  STILL  FURTHER  RESOLVED,  that  the  following  Boards  and

traveled, shall be entitled  to  reimbursement at  the  federal business  rate per mile  for  the

procurement  policy  and  a  procedure  to  authorize  purchases,  obtain  services  and  enter
public works contracts procedure for the Town of Glenville, and
 
    WHEREAS,  said  policy  and  procedure  requires  an  annual  review  by  the
Town Board,
 
    NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town
of Glenville hereby ratifies the Procurement Policy and Procedures and the Authorization
to Make Purchases, Obtain Services or Enter Public Works Contracts Procedure, along
with all amendments made and unanimously accepted thereafter.

    WHEREAS, the Town of Glenville Planning and Zoning Commission
(PZC) routinely solicits engineering firms to assist with the review of technical elements
of subdivision and site plan review applications; and   
 
    WHEREAS, there are a number of qualified local engineering firms who
provide municipalities with consulting engineering services;  
 
    NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the
Town of Glenville hereby authorizes the Town Planner to retain the services of any one
of the following firms to perform an engineering review of any application that comes
before the Planning and Zoning Commission, with the cost for engineering review to be
paid for by the planning/zoning applicant:

monies appropriated for such purposes and without prior approval of the Town Board.

RESOLUTION NO. 10-2011

    WHEREAS Section 284 of the Highway Law requires that money spent for
the  repair  and  improvement  of  highways  in  the  Town  be  spent  pursuant  to  a  written
agreement between the Highway Superintendent and the Town Board; and
 
    WHEREAS  the  attached  agreement  has  been  approved  by  the  Highway
Superintendent and is in the form used by the Town for numerous years,
 
    NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town
of Glenville hereby approves entering into the attached contract with the Superintendent of
Highways  authorizing  the  expenditure  of  $812,331.00  for  the  repair  [5110.0]  and
$160,000.00  for  the  improvement  [5112.0]  of  highways,  sluices,  culverts  and  bridges
having a span of less than five feet in the Town of Glenville; and
 
    BE IT FURTHER RESOLVED that the Town Board of the Town of Glenville
hereby authorizes the Town Superintendent to Highway to expend up to $150,000 of the
funds  authorized  in  the  preceding  paragraph  for  the  repair  and  construction  of  bridges
having a span of  five  feet or more  if such  funds are not needed  for  the purposes stated
above.

assistants during the tax collection periods; and
 
    WHEREAS  the  funds  for hiring part-time assistants, with no benefits, have
been provided by the 2011 Town Budget,
 
    NOW, THEREFORE, BE IT RESOLVED that the Town of Glenville hereby
authorizes  the Receiver of Taxes, at her discretion,  to hire  temporary employees  for  the
collection of 2011 taxes at a monetary level [hours worked, hours paid with no benefits], no
greater than provided for in the 2011 budget.  Expenditure not to exceed $24,365.

Glenville contributes to the Indian Kill Open House and Fishing Day,

of Glenville hereby authorizes the payment not to exceed the sum of One Hundred Dollars
($100.00) to the County of Schenectady to support the Indian Kill Open House and Fishing
Day,  which  will  take  place  in  May,  2011,  and  in  exchange  for  which  the  County  of

York, and
 
    WHEREAS, Freedom Park  is a non profit organization made up of unpaid
volunteers, and
 
    WHEREAS,  Freedom Park  expenses  consist  of  paying  performers  and  a
sound technician as well as maintaining the sound system, and
 
    WHEREAS,  each  year Freedom  Park  strives  to  provide  a  diversity  of
programming that will serve a variety of audiences from preschoolers to senior citizens at
the Wednesday night performances from the end of June through the end of August, and
 
    WHEREAS, acts include big band, country, popular, Polish, Celtic, German,
Jazz, Dixieland and rhythm and blues, and
 
    WHEREAS, admission to all performances are free, and
 
    WHEREAS, most of the funding for Freedom Park comes from contributions
made by individuals and families in the area, and
 
    WHEREAS,  the  Village  of  Scotia  contributes,  each  year,  along  with
maintaining the physical plant, and
 
    WHEREAS,  the  Town  Board  of  the  Town  of  Glenville  is  desirous  of
continuing its support to Freedom Park by giving of its fair share,
 
    NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town
of Glenville hereby authorizes  the Supervisor  to enter  into a contract with  the Village of
Scotia “Freedom Park” in the amount not to exceed One Thousand Six Hundred Twentyfive

Center for citizens over the age of 60;and
 
    WHEREAS, Catholic Family and Community Services of Schenectady and
Catholic Charities of  the Diocese of Albany are desirous of providing a nutrition program
for the citizens over the age of 60 to the Town and its’ senior residents,
 
    NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town
of Glenville  hereby  approves  the  attached  contract  between  the  Town  of Glenville  and
Catholic Family and Community Services of Schenectady and Catholic Charities of
the Diocese of Albany and authorizes payment of a contribution, not to exceed the sum
of  Five  Thousand  Dollars  [$5,000.00],  for  the  provision  of  a  nutrition  program  for  the
citizens over the age of 60 at the Glenville Senior Center; and

    WHEREAS Community Human Services,  Inc., a New York not-for-profit
corporation, having  its principal place of business at 543 Saratoga Road, Glenville, New
York, provides an emergency  youth  shelter and  counseling  services  for  youth and  their
families to youth residing in the Scotia-Glenville and Burnt Hills school districts; and
 
    WHEREAS  the  Town  is  desirous  of  supporting  the  youth  shelter  and
counseling services provided by Community Human Services, Inc.,
 
    NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town
of Glenville hereby approves the attached contract with Community Human Services, Inc.
and agrees to pay to it the sum of Five Thousand Dollars [$5,000.00], in exchange for the
services stated in the contract to be provided by Community Human Services, Inc.; and
 
    BE IT FURTHER RESOLVED that Christopher A. Koetzle, Supervisor of the
Town of Glenville, is hereby authorized to execute this contract on behalf of the Town; and
 
    BE  IT FURTHER RESOLVED  that  the monies will be  taken  from Account

Senior Center on Worden Road in Glenville, New York; and
 
    WHEREAS the Scotia-Glenville Senior Citizens Recreation and Related
Concerns,  Inc.,  a  New  York  not-for-profit  corporation,  wishes  to  provide  programs  for
Glenville seniors in the Senior Center; and
 
    WHEREAS it appears to be in the best interest of the residents of the Town
of Glenville for the Town to enter into a contract with the Scotia-Glenville Senior Citizens
Recreation and Related Concerns, Inc.,
 
    NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town
of  Glenville  hereby  approves  the  attached  contract  with  the  Scotia-Glenville  Senior
Citizens Recreation and Related Concerns, Inc. for its use of the Glenville Senior Center;
and
 
    BE IT FURTHER RESOLVED that the consideration to be paid by the Town
of Glenville to the Scotia-Glenville Senior Citizens Recreation and Related Concerns, Inc.
for  its  programs  for  the  calendar  year  2011  shall  be  the  sum  of  Six  Thousand  Five
Hundred Dollars [$6,500.00]; and
 
    BE IT FURTHER RESOLVED that Christopher A. Koetzle, Supervisor of the

marketing from the Schenectady County Chamber of Commerce; and
 
    WHEREAS  the  current  service  will  include  but  not  be  limited  to  the
Schenectady Military Affairs  (SMAC) work  to  ensure  that  the  109th Auxiliary  at Stratton
National Air Force Base continues; and
 
    NOW,  THEREFORE,  BE  IT  RESOLVED  that  the  Glenville  Town  Board
hereby  authorizes  the  Supervisor  to  contract  for  the  services  of  providing  increased
tourism, economic development promotion and marketing with the Schenectady Chamber
of Commerce for $441.00 in 2011; and
 
    BE  IT FURTHER RESOLVED  that  the monies we be  taken  from Account

participatory programs  in science, history and  the arts  to youth  in  the Town designed  to
arouse curiosity and stimulate an interest in learning; and
 
    WHEREAS,  the  Town  is  desirous  of  supporting  the  offering  of  these
programs to its youth and has budgeted $3,000.00 to that end,  
 
    NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town
of Glenville hereby approves  the attached agreement with the Scotia-Glenville Children's
Museum  and  agrees  to  pay  to  it  the  sum  of  Three  Thousand  Dollars  [$3,000.00]  in
exchange for the services listed therein to be provided by it; and
 
    BE IT FURTHER RESOLVED that Christopher A. Koetzle, Supervisor of the
Town of Glenville,  is hereby authorized to execute  the contract for 2011 on behalf of the
Town; and

    WHEREAS,  the  County  Legislature  of  the  County  of  Schenectady  has
issued  a  Certificate  to  the  Chief  Financial  Officer  of  the  Town  Certifying  that  the
contribution of  the Town of Glenville  to  the  taxes of  the County of Schenectady  for  the
fiscal year beginning January 1, 2011 is $13,594,372.17; and
 
    WHEREAS,  the Town must  levy said sum against  the  taxable  real estate,
and direct the extension of such taxes against each such parcel,
 
    NOW, THEREFORE, BE IT RESOLVED
 
    1.   The Town Board of  the Town of Glenville does hereby  levy  the sum of
$13,594,372.17 by the County Legislature as said Town's contribution to the taxes of the
County of Schenectady for the fiscal year beginning January 1, 2011.
 
    2.    The  taxes  due  the County  of Schenectady  shall  be  extended  against
each parcel of taxable real estate at a rate to be established by the County of Schenectady
per $1000 of taxable assessed value.
 
    3.  The Supervisor is hereby directed to execute and deliver a certificate to
the County  Legislature  of  the County  of Schenectady  certifying  that  the  levy  has  been
made and the extension of taxes directed in accordance with law.

perform an analysis under Government Accounting Standards Board (GASB) Statement
No.45  to value  its post employment benefit obligations other  than pensions  (OPEB)  in
order  to be able  to complete  its 2010 and 2011  financial statement and single audits,
and  
 
    WHEREAS,  the  bid  from  Jefferson  Solutions,  Inc  was  the  lowest
responsible  bid  at  $4,250  for  the GASB Statement No.45  valuation  of OPEB  for  the
Town, and;
  
    WHEREAS,  the cost  for  the GASB Statement No.45 valuation of OPEB  
for  the  Town was  previously  budgeted  for  2011  at  $4,500  to  be  charged  to  account
number 01.00.1315.4500, Fees For Services,  
  
    NOW, THEREFORE, BE  IT RESOLVED,  that  the Glenville Town Board

& casualty insurance and workers compensation insurance and assist in the selection of
an insurance broker for the years 2010 through 2012, and  
 
    WHEREAS,  the  bid  from  Cool  Insurance  Agency  was  the  lowest
responsible bid  for  the  lines of general property & casualty and workers compensation
insurance for the Town in 2010, and
 
    WHEREAS, the Town has received a new quote from the Cool Insurance
Agency for general property & casualty insurance for calendar year 2011 that has been
reviewed by the Town Comptroller in the amount of $141,670; and
 
    WHEREAS,  the  Town  Comptroller  recommends  that  the  Town  Board
accept  the  quote  for  general  property  &  casualty  insurance  from  the Cool  Insurance
Agency for calendar year 2011 as in the best interests of the Town; and
  
    WHEREAS,  the cost of  the 2011 general property & casualty  insurance

    WHEREAS,  the  Schenectady  County  Civil  Service  Commission  has
approved the creation of the title of Director of Operations for the Town of Glenville; and
 
    WHEREAS,  James  MacFarland  has  served  the  Town  as  Director  of
Human  Resources  and,  throughout  2010,  as  Acting  Director  of  Operations  in  an
exemplary manner; and
 
    WHEREAS, James MacFarland meets all of the qualifications and criteria
to serve as Town Director of Operations and has been recommended to fill such position
by the Town Supervisor;
 
    NOW,  THEREFORE,  BE  IT  RESOLVED,  that  the  Town  Board  of  the
Town of Glenville hereby appoints James MacFarland as Town Director of Operations
with a 2011 salary of $79,500.

    WHEREAS, Section 113 of  the New York State Agriculture and Markets
Law permits municipalities to contract with one another for the provision of Dog Control
Officer services; and
 
    WHEREAS, the Town of Charlton, Saratoga County, adjoins the Town of
Glenville, Schenectady County; and
  
    WHEREAS,  the  Town  of  Charlton  has  a  new  Dog  Control  Ordinance,
effective January 1, 2011 and has approved a new  job description  for  its Dog Control
Officer; and
 
    WHEREAS,  the Town of Charlton  is desirous of entering an agreement
with the Town of Glenville to share Dog Control Officer services on an as-needed basis;
and
 
    WHEREAS, the Town Board of the Town of Charlton has, by appropriate
resolution, approved the proposed Inter-municipal Agreement with the Town of Glenville
to  provide  cooperative  dog  control  services  for  the  year  2011  wherein  the  Town  of
Charlton would pay the Town of Glenville the sum of $6,453.00 for such services; and
 
    WHEREAS, the Town Board of the Town of Glenville has determined that
it can provide such services to the Town of Charlton without any substantial reduction of
Dog Control Officer services within the Town;
  
    NOW,  THEREFORE,  BE  IT  RESOLVED,  that  the  Town  Board  of  the
Town of Glenville hereby authorizes the Supervisor to enter into the attached one-year
inter-municipal agreement with  the Town of Charlton  for  the  provision of Dog Control
Officer services in the amount of $6,453.00.

payroll management system; and
 
    WHEREAS,  the Town Police Department has maintained a database  to
track all time accruals for members of the department with staff within  the department;
and
  
    WHEREAS,  the  employee  familiar  with  the  department’s  database

    WHEREAS, the Police Department database needs to be maintained until
such time as the Town’s new payroll management system is fully operational, a process
that may not be completed for several weeks; and  
 
    WHEREAS,  the Police Department  is  in  need  of  a part-time,  temporary
employee  to manage  its  payroll  database  for  the  next  several weeks  and  can  obtain
such  help  through  a  part-time,  temporary  clerk  at  the  rate  of  $16.00/hour,  with  no
benefits;
  
    NOW,  THEREFORE,  BE  IT  RESOLVED,  that  the  Town  Board  of  the
Town of Glenville hereby authorizes  the Chief of Police  to hire a part-time,  temporary
clerk for the maintenance of the Police Department payroll database at an hourly rate of
$16.00 per hour, with no benefits, to work no more than 15 hours per week for no more
than thirteen weeks.

development standpoint and I am looking forward to working with Councilman Boulant as

    Councilwoman Wierzbowski –  “I would  like  to echo Councilman Ramotar’s
sentiments.  I think we had a very productive year last year.  We seemed to accomplish a
lot of what we set out to do, we work together well which always makes things easier.  I
am  excited  about  staying  in  my  role  as  liaison  to  the  Public  Works  Department.  
Superintendent Coppola has been exceedingly kind and helpful to me over the year and I
enjoy that role.”
 
    Councilman Boulant – “It was an interesting year.  We all worked very hard
in what we  accomplished  and  I  am  looking  forward  to  the  economic  development  role.  
There are a lot of active things that I am pursuing.  Hopefully we will be seeing some new
businesses coming into town.”
 
    Councilman  Quinn  –  “I  would  like  to  congratulate  the  Board  on  a  very
productive year and  the strategic plan was very comprehensive and was well conceived
and much of it has already been accomplished, I think that is a wonderful thing.
 
    To  John Pytlovany,  congratulations,  I  think  you  are  a  tremendous  choice,
you knowledge in the public safety arena and all so within Town and the Village especially
is going to serve this Board very well.  Just for clarification sake, for both the public and the
press  I  just wanted  to mention  that  I will  be  stepping  down  on March  1st  and  I will  be
leaving my position in the capable hands of John.”
 
    Supervisor Koetzle – “I want to again say congratulations and I am looking
forward  to next week.   Again,  I  invite  the public  to come out and send us any questions
you might have for John.  Seeing what we have to accomplish this year, public safety is a
busy area  for us and an  important area and we have got a  lot of questions around  the
U.C.C. and getting the contract settled so we are looking for your expertise.  We invite you
to  really start getting  involved  in asking questions and maybe  talking with  the Chief and
maybe  Councilman  Boulant maybe  can  help  you  with  some  of  the  transitions.    I  look
