Present:        Supervisor Frank X. Quinn, Councilmen Edward F. Rosenberg, Mark A. Quinn, and Councilwoman Valerie M. DiGiandomenico

                The following resolutions were acted upon.

RESOLULTION NO. 184-2009

                Supervisor Quinn – “We have one add on resolution.  This resolution is about a severance pay to the Town Administrator because the incoming Board has decided that they are not going to renew his contract.  We have two different resolutions, one offering 10 working days severance pay (two weeks notice) and the other is 20 working days severance pay, and everything else is the same.  Do you give a person a two week notice or a four week notice?”

                Councilwoman DiGiandomenico – “I feel that Tony has to give us a months notice if he was going to leave and I think it is only fair that we should compensate him and give him a months notice.”

Discussion…

                Councilman Quinn – “Is there any stipulation in Tony’s contract guaranteeing a certain level of severance regardless of the circumstances?”

                Supervisor Quinn – “Not to my knowledge.”

                Councilwoman DiGiandomenico – “There’s no severance pay at all?”

                Supervisor Quinn – “It’s not listed as a severance pay other than the notifications.”

                Councilman Quinn – “I agree that Tony’s service has been exemplary.  Between the cash out that he’ll be getting under the normal circumstances and the other resolution which I will support. I am going to say no to this one.”

                Councilman Rosenberg – “Tony knows that I certainly appreciate his work, his performance and everything.  I know it’s not in the contract and I am going to echo Councilman Quinn’s sentiments.  I will certainly support the other resolution.”

RESOLUTION NO. 185-2009

Seconded by:    Supervisor Quinn

                WHEREAS the Supervisor-Elect advised the Town Administrator that his annual contract and the March 9, 2007 conditions of employment would not be re-authorized effective January 2010;

                WHEREAS the Town Administrator’s separation from employment with the Town of Glenville is effective the close of business December 31, 2009;

                WHEREAS the Town Administrator has served the Town of Glenville in an exemplary manner and is deserving of authorized severance pay;

                NOW, THEREFORE BE IT RESOLVED by the Town Board of the Town of Glenville that the Town Comptroller is directed to provide the Town Administrator with 20 days of severance pay, in addition to his unused accrued leave time, by December 31, 2009

Noes:           Councilmen Quinn and Rosenberg
Absent: Councilman Koetzle

Discussion…

                Supervisor Quinn – “This one is for a two week or 10 day severance pay.”

                Councilman Rosenberg – “I don’t think Tony had any expectations from his contract.  Although maybe it wasn’t legally official, I know that it has been a week and a half since you were given notice so there’s that plus the 10 days I think is more than fair, trying to be fair above and beyond what the contract states.”

                Supervisor Quinn – “We all know that the incoming Board said they were not going to renew the contract and so that is their prerogative, they’re certainly entitled to do that, there’s nothing unusual about that.  While personally I disagree with it, I have got nothing to say about it, that’s their call, fine and dandy.

                The prior Board had to take an action, they can’t give somebody a severance notice, they don’t exist until the 1st of January.  They can make their intentions known and that’s fine and they did.  This is this Board’s action to do what it has to do regarding this matter.”

RESOLUTION NO. 186-2009
