Glenville Residents to Receive $1.2 Million in Cable TV Refunds

On March 7th, the NYS Attorney General, on behalf of the Town of Glenville, reached an agreement with Time Warner Cable in relation to the company overcharging their Glenville subscribers.  The complaint was brought by the Town of Glenville to the Attorney General while the town was negotiating a new franchise agreement in 2010.  The town was made aware of this overcharge by a resident.  The company’s previous contract with the town allowed for a 2% “pass through” of its franchise fee to the customer.  The company was charging Glenville subscribers 5% however.

This settlement means that the customers who were impacted will be receiving a full refund within 90 days totaling nearly $1.2 million.  This credit will occur on your bill and will be labeled “Franchise Fee Credit.” The average refund will amount to about $150 per customer, but some subscribers may see as much as $300 depending on their services. 

Further, Time Warner has agreed to lower their franchise fee from the current 5% back to the contractual 2% on every customer's account going forward.  This will save every subscriber about $1.50 per month, every month.  This fee will be lowered within the next 60 days.

I want to thank our residents for their support and the staff and town board for their hard work and commitment to seeing this matter through to completion.  In particular, I want to thank Town Attorney Michael Cuevas for his keen counsel and strong dedication to this case, without which we would not have been successful. It was his strong belief that Time Warner was indeed overcharging our residents that gave the board the fortitude to pursue this matter over the past four years.

Finally, to our residents: you should know that this board will not tolerate any company overcharging our residents for any services.  This board remains solely focused on making this community better through economic development, more transparency and fiscal responsibility.  That fiscal responsibility means staying focused on our residents’ best interests.  I am proud of the board’s record on delivering such a government and on its determination to serve the people of Glenville to the best of its ability.
