ZONING BOARD OF APPEALS
PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, April 25, 2005 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.
Application of Kevin Garcia, 62 Heritage Parkway, Glenville, NY 12302 for a Sign Variance for the Dunkin Donuts to be constructed at 2901 Amsterdam Road, Glenville, NY 12302. The variance requested is for a 34” x 7’ wall sign advertising the business name on the right side of the building. This sign is in addition to a wall sign on the front of the building and a pole sign – both advertising the business name. Said property is located just west of Tel Oil on Amsterdam Road, is located in a Community Business Zoning District and is identified on tax map 28.8-1-4.1.
In accordance with the Town of Glenville Zoning Ordinance Article 9. 3(a) – no more than two external signs displaying the business names shall be allowed.
Application of James Mastroianni, 104 Freemans Bridge Road, Glenville, NY 12302 for a Use Variance that will allow for the construction of a 20’ x 30’ addition to the existing single family dwelling currently occupied by the applicant. The residence is located on the site of the Glenville Mini Sportplex. Said property is located in a General Business Zoning District and is identified on tax map 30.15-1-13.11
In accordance with the Town of Glenville Zoning Ordinance Article 5.F – There are no provisions for a single family dwelling in the General Business Zoning District and Article 15.D - Nonconforming buildings and uses cannot be expanded or in any way enlarged.
Application of Sitterly Road Realty, LLC (Stephen Weekes & Peter Rosenfeld) for a Use Variance which would allow for the construction of a 4,800 sq. ft. six bay car wash at 160 Saratoga Road Glenville, New York 12302. (site of the former “Ye Ole Terwilliger Farm”). Said property is located in a Community Business Zoning District and is identified on tax map 22.15-3-24
In accordance with the Town of Glenville Zoning Ordinance Article 5.E – There are no provisions for a commercial car wash facility in the Community Business Zoning District.
Application of Gregg Gibbons, 33 Washington Ave, Scotia, NY 12302 for an Area Variance at the intersection of Barhydt Road and Wagner Road. The entire parcel currently consists of two lots. The variances would allow the applicant pursue an application to subdivide one lot into two lots and re-adjust an existing lot line. If subdivision approval is granted, all three lots would be substandard. Lot 6 requires a variance for minimum lot size, Lots 4 & 5 require variances for lot width. Said property is located in a Rural Residential/Agricultural Zoning District and is identified on tax map 20.-4-19.11.
In accordance with the Town of Glenville Zoning Ordinance Article 5.A(5) – minimum lot size for properties without public water is 3 acres and the minimum lot width is 300’.
