ZONING BOARD OF APPEALS
PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, November 22,. 2004 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.
Application of David DePaulo, 2 Windsor Drive, Glenville, NY 12302 for two Area Variances that will allow for the construction of a new 24’ x 22’ two-stall garage 20 feet from the westerly property line and also for the construction of a new front porch 35 feet from the front property line on Windsor Drive. The building would be used for the DePaulo Insurance Agency pending approval of a Site Plan Review by the Planning & Zoning Commission. Said property is located in a Professional Residential Zoning District and is identified on tax map 22.15-2-45.2
In accordance with the Zoning Ordinance for the Town of Glenville Article 3.D.13 – Transitional Yard Requirements Adjacent to Commercial Uses: Where the side or rear lot line of a property in which a commercial use is proposed abuts a property that is either already used for residential or park use, or is zoned for residential or park use, a minimum 30 foot wide buffer is to be maintained between the developed portion of the commercial site and the abutting side or rear property line. This buffer is to remain free of buildings, structures, parking, roadways, dumpsters, etc. Further, the Planning and Zoning Commission and/or the Zoning Board of Appeals may require landscaping, fencing, berming, and other forms of screening within this buffer area; and Article 5.D.4 – the minimum
front setback shall be 40 feet.
Application of Raymond & Virginia Thimineur, 162 Willow Lane, Glenville, NY 12302 for an Area Variance that will allow for the construction of a 10’ x 12’ deck 5 feet from the rear property line. Said property is located in a Suburban Residential Zoning District and is identified on tax map 16.17-2-7.
In accordance with the Zoning Ordinance for the Town of Glenville Article 5.B.5 – the minimum rear setback shall be 35 feet.
Application of Philip L. Horstman, 7 Swaggertown Road, Glenville, NY 12302 for a Conditional Use Permit and an Area Variance that will allow for the expansion an existing farm stand located on Ballston Road adjacent to the Stewart Shops. The project includes the removal of the existing farm stand and the construction of a new 1,200 sq. ft. farm stand as well as a new 3,000 sq. ft. greenhouse. Said property is located in a Suburban Residential Zoning District and is identified on tax map 30.10-1-27.
In accordance with the Zoning Ordinance for the Town of Glenville Article 5.B.4 – roadside produce stands are permitted by Conditional Use Permit and Article 5.B.4 – roadside produce stands shall not exceed a building footprint of 600 square feet.
Continuation of the application of Al Rullo, Capitaland Motors, 141 Saratoga Road, Glenville, NY 12302 to rehear the condition of the Use Variance approval. Mr. Rullo is seeking to eliminate the condition placed by the ZBA to reduce the height of existing light poles by 5 feet.
